Iron Mountain Training Group – RELEASE, WAIVER, ASSUMPTION OF RISK AND TERMS OF USE AGREEMENT

This Agreement (the “Agreement”) is entered into by and between the undersigned (the "User") and Iron Mountain Training Group ("IMTG"), including its agents, sponsors, employees, volunteers, affiliates, and all other persons or entities associated with IMTG (collectively, the "Owner"). By participating in any event, course, or activity hosted or facilitated by IMTG (the "Event"), the User acknowledges and agrees to the following terms:

1. Acknowledgment of Risk

The User acknowledges that participation in any training course, event, competition, or any other activity associated with IMTG (the "Event") involves inherent risks, including but not limited to the use and discharge of firearms, munitions, explosives, or other armaments (collectively, “Munitions”). These activities may result in bodily injury, death, or property damage. The User is fully aware of these risks and voluntarily assumes all risks associated with their participation in the Event.

2. Assumption of Responsibility for Injury or Death

The User assumes full responsibility for their own safety and actions while attending or participating in any Event. This includes any injury, death, or damage to property that may occur as a result of the User’s actions, misuse of Munitions, or failure to follow safety protocols. IMTG is not responsible for any consequences arising from the use of skills learned in training, nor for any failure to apply those skills effectively in real-life situations, whether inside or outside the training environment.

3. Release and Waiver of Liability

In consideration for being allowed to participate in the Event, the User releases, waives, and discharges IMTG and its partners, agents, employees, and affiliates from any and all liability, claims, demands, or actions arising from or related to any injury, death, or property damage incurred as a result of participating in the Event. This waiver applies to any claim, including those based on negligence, and includes any harm that might occur during or after the Event, whether on or off the property where the Event is held.

4. Indemnification and Hold Harmless

The User agrees to indemnify, defend, and hold harmless IMTG, its officers, agents, employees, and volunteers from any and all losses, damages, claims, demands, lawsuits, legal actions, or liabilities, including attorney's fees and court costs, arising from the User’s participation in any Event. This includes any actions brought against IMTG by any third party arising out of the User’s conduct or the use of skills learned during the Event.

5. No Liability for Real-Life Use of Training

By entering this Training Course or Event, the User acknowledges that IMTG is not responsible for any consequences arising from the use of training outside the Event, including but not limited to real-life self-defense situations, law enforcement operations, or any other real-world application. This includes situations where the training may not be effective, where the skills are not successfully applied, or where the training leads to injury, death, or damage.

6. Termination of Participation

IMTG reserves the right to terminate or suspend the User’s participation in any Event at its discretion, at any time, for any reason, including safety violations, disruptive behavior, or failure to follow instructions. In the event of such termination, the User will not be entitled to a refund of any fees or costs associated with the Event.

7. No Right to Jury Trial / Arbitration

The User agrees to waive their right to a jury trial for any dispute arising from this Agreement. Any disputes will be resolved by binding arbitration before an arbitrator selected by IMTG, at a location designated by IMTG, and under the rules of the American Arbitration Association.

8. Safety Protocols and Expectations

The User acknowledges that they will receive a safety briefing at the beginning of each Event, and agrees to follow all safety rules, protocols, and instructions provided by IMTG staff, judges, or safety officers. Failure to follow these instructions may result in immediate removal from the Event without a refund.

9. Media Release

By participating in the Event, the User grants IMTG permission to capture, record, and use photographs, videos, and audio recordings of the User during their participation. These materials may be used for marketing, promotional, or educational purposes, including but not limited to social media, websites, and advertisements. If the User does not wish to be included in such media, they must notify IMTG in writing prior to the Event.

10. Payment and Refund Policy

a. Payment: The User agrees to pay the applicable fees for the Event at the time of registration. Fees must be paid in full prior to participation in the Event.
b. Cancellations and Refunds: IMTG reserves the right to cancel any Event due to unforeseen circumstances (e.g., weather, facility issues, etc.). In the event of such a cancellation, the User will be offered a full refund or the opportunity to transfer their registration to a future Event.
c. No Refunds for Personal Cancellation: If the User cancels their participation for any reason, they may not be eligible for a refund. IMTG may, at its discretion, offer credit toward future training or events.

11. Compliance with Laws

The User agrees to comply with all local, state, and federal laws related to firearms, ammunition, and safety while participating in any Event. The User affirms that they are legally permitted to possess and use firearms in the jurisdiction where the Event is held and that they are in compliance with all applicable regulations.

12. Equipment and Ammunition

a. User’s Equipment: The User is responsible for ensuring that their firearm and equipment are in safe working condition and comply with the requirements set by IMTG. IMTG may reject the use of any equipment deemed unsafe or inappropriate for the Event.
b. Ammunition: The User agrees to provide their own ammunition for training courses and events. IMTG may restrict the use of certain types of ammunition (e.g., steel core, tracers) for safety reasons. If the User is unable to provide ammunition that meets the Event's requirements, they may be asked to leave the Event without a refund.

13. Health and Fitness Requirements

The User affirms that they are in adequate physical and mental health to participate in any Event. The User understands that training and competitions may require physical exertion and mental focus, and it is their responsibility to consult a healthcare professional before participating if they have any concerns about their ability to safely engage in the Event.

14. Intellectual Property

The User acknowledges that all instructional materials provided during training courses, including manuals, videos, and digital content, are the intellectual property of IMTG and may not be reproduced, distributed, or shared without the prior written consent of IMTG.

15. Event Rules and Conduct

The User agrees to adhere to all Event-specific rules provided by IMTG, including those related to competition formats, safety guidelines, and behavioral expectations. IMTG reserves the right to remove any participant who engages in disruptive, unsafe, or unethical conduct, with no refund issued. This includes, but is not limited to, behavior that threatens the safety or well-being of others, cheating during competitions, or using drugs or alcohol during an Event.

16. Force Majeure

IMTG will not be held liable for any delays, cancellations, or failures to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, accidents, war, terrorism, government actions, or health crises such as a pandemic. In such cases, IMTG may reschedule or cancel the Event and will offer a full refund or transfer for rescheduled dates.

17. User’s Responsibilities During the Event

The User agrees to:

  • Follow all safety instructions provided by IMTG staff and instructors.

  • Wear appropriate safety gear (such as ear and eye protection) as required.

  • Not consume alcohol or drugs during the Event or be under the influence while participating.

  • Report any unsafe conditions or accidents to IMTG staff immediately.

18. Acknowledgment of Full Understanding

By signing below, the User acknowledges that they have read, understood, and agreed to all the terms and conditions outlined in this Agreement. The User understands that their participation in the Event is voluntary, and they accept full responsibility for their actions, behavior, and any consequences that may arise.
